The Garden crossword terms and conditions

  1. THE PROMOTER
    1. The promoter is: The Royal Horticultural Society (RHS) of 80 Vincent Square, London, SW1P 2PE
  2. THE COMPETITION
    1. The title of the competition is The Garden Cryptic Crossword
    2. A monthly cryptic gardening crossword to be entered by email only. Winners will be chosen at random from correct entries received
  3. HOW TO ENTER
    1. The ‘How to enter’ instructions (including the opening and closing dates for entries) in The Garden magazine form part of the rules. All entries must be submitted as detailed in The Garden magazine
    2. All competition entries must be received by the Promoter to the email address [email protected] by no later than 5pm on the closing date. All competition entries received after the closing date are automatically disqualified
    3. To enter the competition: Send a copy of your completed grid, either by photograph or scan to: [email protected] with the subject line of TG (month) crossword competition
    4. No purchase necessary
    5. The Promoter will not accept:
      1. Responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind
    6. By submitting a competition entry, you are agreeing to be bound by these terms and conditions. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions

    8. The winner will be chosen at random from the correct entries. The decision of the Editor will be final
  4. ELIGIBILITY
    1. The competition is only open to all residents in the UK (aged 18 years or over), except:
      1. Employees of the Promoter or its holding or subsidiary companies;
      2. Employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      3. Members of the immediate families or households of 4.1.1 and 4.1.2 above
    2. In entering the competition, you confirm that you are eligible to do so and eligible to claim (the prize OR any prize you may win). The Promoter may require you to provide proof that you are eligible to enter the competition
    3. The Promoter will not accept competition entries that are: automatically generated by computer; completed by third parties or in bulk; illegible, have been altered, reconstructed, forged or tampered with; photocopies and not originals; or incomplete
    4. There is a limit of one entry to the competition per household. Entries on behalf of another person will not be accepted and joint submissions are not allowed
    5. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

  5. THE PRIZE
    1. The ‘How to enter instruction’ in The Garden magazine, provides the details of the prize
    2. Prizes are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value
    3. The prize is not negotiable or transferable
  6. WINNERS
    1. The decision of the Editor is final and no correspondence or discussion will be entered into
    2. The winner will be notified by email (using details provided at entry) and must provide a postal address to claim their prize
    3. The winner will be published in a following edition of The Garden magazine, by name and county
    4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter by email to [email protected]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request
  7. CLAIMING THE PRIZE
    1. Please allow up to 28 days for delivery of the prize
    2. The prize may not be claimed by a third party on your behalf
    3. The Promoter will make all reasonable efforts to contact the winner. If a winner does not respond to the Promoter within 2 working days of being notified by the Promoter, then the winner’s prize will be forfeited. The Promoter will be entitled to select another winner in accordance with the process described above
    4. The Promoter does not accept any responsibility if you are not able to take up the prize
  8. LIMITATION OF LIABILITY
    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected
  9. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
    1. All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned
    2. 9.2 By submitting your competition entry and any accompanying material, you agree to:
      1. Assign to the Promoter all your intellectual property rights with full title guarantee; and
      2. Waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world
  10. DATA PROTECTION AND PUBLICITY
    1. Unless you have chosen to receive other information from us, your personal data supplied during the course of this promotion will be used by the Promotor for the purpose of running the prize draw, including contacting the winner and distributing the prize, and as set out in condition 12 regarding the announcement of the winner. The personal data of all entrants apart from the winner will be kept for a period of 60 days from the closing date and then deleted. The personal data of the winner will be kept until after the prize is taken and then deleted.   11. GENERAL
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales
