Terms of Use for the School Gardening Award

These Terms of Use apply to all School Gardening Awards (each an “Award”).

1. Award Recipient: The Award Recipient is the entity or person that is the named school, group, or Individual that has been awarded the Award. Each Award Recipient will receive a physical certificate from the RHS.

2. Individual: In these Terms of Use an Individual means a childminder or a home educator.

3. The Digital Asset: Where a digital asset of the Award is available, the RHS will provide the appropriate level of digital asset to the Award Recipient. An Award Recipient may only use the Digital Asset provided to it by the RHS and must not create their own physical, photographic or digital image for the Award or create anything confusingly similar to, or alter, any Digital Asset provided by the RHS.

4. The Award Statement: If an Award Recipient wishes to refer to winning an Award, they must use the Award Statement, which specifies the level of the Award, and the year in which the Award was awarded. For example: 

[Level 5] RHS School Gardening Award Recipient [2024].

5. Use of the Award, Digital Asset and/or Award Statement: No one other than the Award Recipient is permitted to use the Award, Digital Asset and Award Statement. For example, where the Award Recipient is a school within a group of schools in a multi-academy trust, other schools within that trust are not permitted to use the Award, Digital Asset or Award Statement. The Award Recipient may use the Award, Digital Asset and/or Award Statement in its own printed and digital marketing materials.

6. All other uses are prohibited: Unless the RHS has given its prior written consent, all other uses of the Award, Digital Asset or Award Statement are strictly prohibited. An Award Recipient must not permit, allow or enable any third parties to use the Award, Digital Asset or Award Statement, or anything confusingly similar to them.

7. Duration: An Award Recipient may use the Award, Digital Asset and Award Statement for a period of five (5) years from the end of the year in which the Award was awarded. After this period, the Award Recipient must immediately cease their use of the Award, Digital Asset and Award Statement, as applicable.

8. RHS Trade Marks: Use of the RHS’ names, logos or trade marks other than as set out in these Terms of Use is strictly prohibited.

9. Conduct: An Award Recipient must not do anything that, in RHS’s reasonable opinion: (a) does not align with the RHS’s current aims, strategy or policies; or (b) may bring the RHS or the Award into disrepute, or damage their reputation or goodwill.

10. Termination of Use: On written notice, the RHS may terminate an Award Recipient’s rights early under these Terms of Use if the RHS reasonably considers that they have not complied with these Terms of Use, and on receipt of the notice they must immediately cease their use of the Award, Digital Asset and Award Statement, as applicable.

11. Amendment: The RHS may amend these Terms of Use from time to time. The RHS will make the current Terms of Use available on the RHS Campaign for School Gardening website. Please check to ensure you comply with the current Terms of Use.
