Terms of Use for the RHS Environmental Innovation Award

These Terms of Use apply to the RHS Environmental Innovation Award (the “Award”).

1. Award Winners: Each of the designer, the primary contractor and the sponsor of the award-winning garden are Award Winners.

2. The physical Award: A physical award and roundel will be awarded to the award-winning garden from the RHS.

3. The Digital Asset: Where a digital asset of the Award is available, the RHS will provide it to the coordinator of the award-winning garden who will be responsible for distributing it to each Award Winner. An Award Winner must not create their own physical, photographic or digital image of the Award, or anything confusingly similar, using the physical Award or roundel or by any other means, or alter any digital asset provided by the RHS.

4. The Award Statement: If an Award Winner wishes to refer to winning an Award, they must use the Award Statement, which specifies the name and year of the RHS Show in which the Award was awarded and name of the award-winning garden. For example:

RHS Environmental Innovation Award Winner at the RHS [Hampton Court Palace Garden Festival] [2025] for [the Subaru Cocoon Garden].

5. Use of the Award and/or the Award Statement: No one other than the Award Winner is permitted to use the Award and the Award Statement. The Award Winner may use the Award and/or the Award Statement in its own printed and digital marketing materials related to its business, and in retail displays relating to its business. Examples of prohibited uses include use of the Award or Award Statement on products, product labels or packaging, vehicles, uniforms or signage (other than signage within a retail display).

6. Key Suppliers’ Statement: Key Suppliers may refer to their role in providing products or services to the award-winning garden. Examples of Key Suppliers include suppliers of landscaping and other specialist services (e.g. dry-stone walling, plumbing and tiling) and suppliers of garden products (e.g. buildings and furniture). To use the Key Suppliers’ Statement, they must include the name and year of the RHS Show and the name of the award-winning garden. Key Suppliers may not refer to themselves as winners; or refer to the Award being their award; or their products or services being award-winning. For example:

[Low carbon bricks] provided for the [Subaru Cocoon Garden], the RHS Environmental Innovation Award Winner at the RHS [Hampton Court Palace Garden Festival] [2025].

A Key Supplier may only use the Key Suppliers’ Statement, in the form set out above, in its own printed and digital marketing materials related to its business, and in retail displays relating to its business. Examples of prohibited uses include use on products, product labels or packaging, vehicles, uniforms or signage (other than signage within a retail display).

7. All other uses are prohibited: Unless the RHS has given its prior written consent, all other uses of an Award or Statement are strictly prohibited. An Award Winner or Key Supplier must not permit, allow or enable any third parties to use an Award, Statement or anything confusingly similar to them.

8. Duration: An Award Winner may use the Award and Award Statement, and a Key Supplier may use the Key Supplier’s Statement, for a period of three (3) years from the last date of the RHS Flower Show in which the Award was awarded. After this period, an Award Winner must immediately cease its use of the Award and Award Statement, and a Key Supplier must immediately cease its use of the Award Statement.

9. RHS Trade Marks: Use of the RHS’ names, logos or trade marks other than as set out in these Terms of Use is strictly prohibited.

10. Conduct: An Award Winner or Key Supplier must not do anything that, in the RHS’s reasonable opinion: (a) does not align with the RHS’s current aims, strategy or policies; or (b) may bring the RHS, the Award or the RHS Show into disrepute, or damage their reputation or goodwill.

11. Termination of Use: On written notice, the RHS may terminate an Award Winner’s or Key Supplier’s rights under these Terms of Use if the RHS reasonably considers that they have not complied with these Terms of Use, and on receipt of the notice they must immediately cease their use of the Award and Statement, as applicable.

12. Amendment: The RHS may amend these Terms of Use from time to time. The RHS will make the current Terms of Use available in the online exhibitor portal each year and on the RHS website. Please check to ensure you comply with the current Terms of Use.
