RHS Heritage Catalogue Terms and Conditions

The Royal Horticultural Society (the “RHS”) is a charity registered in England and Wales and Scotland (charity numbers 222879/SC038262) with a registered address at 80 Vincent Square, London, SW1P 2PE. References to “we”, “us” and “our” in these Terms means the RHS.

These terms and conditions apply to your use of the RHS Heritage Catalogue.

1. UNDERSTANDING THESE TERMS
  1. These terms and conditions (“Terms”) set out the terms on which any person may use the RHS Website www.RHS.org.uk to access the RHS Heritage Catalogue (“you” or “your”).
  2. By using the RHS Website to access the RHS Heritage Catalogue, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, you must not use view the RHS Heritage Catalogue.
  3. If you use other parts of the RHS Website additional terms and conditions may apply.
  4. We reserve the right to change the RHS Website and access to or use of the RHS Heritage Catalogue at any time.
  5. You acknowledge that we cannot guarantee the availability of the RHS Website or RHS Heritage Catalogue. We may suspend, withdraw or restrict the availability of all or any part of the RHS Website or RHS Heritage Catalogue for commercial or operational reasons.
  6. We reserve the right to change these Terms from time to time.
2. TERMS OF USE
  1. You can view the RHS Heritage Catalogue to use the content provided that you use the content in accordance with these Terms and the relevant  Creative Commons license as indicated in the field marked {insert name of field in Heritage Catalogue display} : following terms: 
    (a) Non-commercial use with attribution permitted (CC BY-NC 4.0) - content with this license is for information purposes and/or reproduction for personal/academic use only, and not for commercial use. This license permits reusers to distribute, remix, adapt, and build upon the material in any medium or format, for non-commercial purposes only.
    (b) Non-commercial use with attribution permitted, no derivatives permitted (CC BY-NC-ND 4.0) – this permits you to use and share the content except for commercial use. Commercial use means using an item in any manner that is intended for commercial advantage or monetary compensation. You may not modify the item.
    (c) Public Domain (CC0 1.0) - content with this license is available for commercial use.
  2. Except where indicated in the information displayed alongside the content, we are the owner or licensee of the copyright and any other intellectual property rights, in the content of the RHS Website and RHS Heritage Catalogue.
  3. ‘The Royal Horticultural Society’, ‘RHS’ and our logos are our registered trademarks. You must not use these without our prior consent, unless they are part of the content you are permitted to use under this clause 2 (Terms of Use).
  4. Any reused content must acknowledge the RHS or other identified contributors, as authors of the item, as indicated in the field marked “credit line” displayed alongside the content.
  5. If you use, reproduce and/or modify any content in breach of these Terms, we may (a) end your right to use the RHS Heritage Catalogue with immediate effect, and (b) require that you must, at our option, return or destroy copies of the items you have made. This is in addition to any other rights we may have.
  6. You must not permit any text or data-mining or web-scraping in relation to the RHS Heritage Catalogue. Researchers requiring large amounts of data are expected to contact us at [email protected] with details about their project and ways in which we can collaboratively exchange data.
3. LAWFUL USE OF THE RHS WEBSITE AND RHS HERITAGE CATALOGUE:
  1.  When you use the RHS Website and the RHS Heritage Catalogue you must not:  
    (i) in any way breach any applicable law or regulation;.
    (ii) infringe the copyright, trademarks or other intellectual property rights of third parties
    (iii) in any way be abusive, vulgar, obscene, unlawful, fraudulent, threatening, defamatory and/or or hateful to any person;
    (iv) violate the privacy or other personal rights of others; and 
    (v) use the RHS Website and RHS Heritage Catalogue in a way which may harass, offend or inconvenience any person, or applauds, encourages or entices abuse, discrimination or criminal activity or in a way which is unlawful or that might bring the RHS into disrepute.
4. VIRUSES
  1. We do not guarantee that the RHS Website and RHS Heritage Catalogue will be error free, secure or free from bugs or viruses.
  2. You are responsible for configuring your information technology, computer programmes and platform to access the RHS Website and RHS Heritage Catalogue. You should use your own virus protection software.
  3.  You must not misuse the RHS Website and RHS Heritage Catalogue by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. 
5. PRIVACY

6. GENERAL
  1. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you for being in breach of these Terms, that does not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.  
  2. We do not make any representations or warranties about the accuracy of the content in the RHS Heritage Catalogue.
  3. We do not guarantee that your use of any content found on the RHS Website and RHS Heritage Catalogue will not infringe any third-party copyright or other intellectual property rights.
  4. The RHS will not be liable for any direct, indirect or consequential damages relating to your use of the RHS Website or RHS Heritage Catalogue (even if foreseeable) whether based on contract, tort or otherwise, to the fullest extent permitted by law. This includes but is not limited to liability for: loss of data or profits; interruptions or delays; or any information obtained through the RHS Website or RHS Heritage Catalogue.
  5. You will be liable to us if you fail to comply with these Terms. This means that you will be responsible for any loss or damage that we suffer as a result of you not complying with these Terms.
  6. These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales.
